Wayne Leistico, a 30-year-old Elk River man, has been sentenced to 30 years in prison for criminal sexual conduct in the first and second degree in Sherburne County 10th District Court. Judge Sheridan Hawley sentenced Leistico to the statutory maximum. Leistico pled guilty to the charges in August 2013. An investigation of Leistico began in December 2012 when a video of Leistico engaging in a sexual act with a 7-year-old victim was discovered by a family member, according to Sherburne County Sheriff Joel Brott. The video was turned over to the Sheriff’s Office as evidence. Leistico was taken into custody shortly thereafter. Search warrants were executed in Sherburne and Anoka counties by members of the Sherburne County Criminal Investigation Division. As a result of those warrants, additional evidence was discovered that showed Leistico was also in possession of more than 1,200 images of suspected child pornography, Brott said. Assistant County Attorney Leah Emmans said she is hopeful that the lengthy prison sentence will provide some relief for the victim and for her parents.
“Her mom and dad have made every court appearance,” she said. “Their impact statements to the court were a powerful reminder that no prison sentence repairs the damage that the victims and their loved ones suffer in cases such as these.” Leistico awaits possible charges in Federal Court for possession and manufacturing of child pornography.
