PLEASE TAKE NOTICE, that on the foregoing Notice of Motion and Motion, Affidavits filed herein, and the Court being duly advised,
IT IS HEREBY ORDERED, that you, Sara Lynn Eigenheer, personally appear before the Honorable Thomas Hayes, Judge of the above-named Court at the Sherburne County Courthouse in the City of Elk River, County of Sherburne and State of Minnesota on the 27th day of November, 2013, at 8:00 a.m., or as soon thereafter as counsel may be heard, to show cause, if any, you may have, why a Custody Order should not be made granting Respondent the relief prayed for in the said Notice of Motion and Motion attached hereto.
IT IS HEREBY ORDERED, Respondent is granted temporary legal and physical custody of the minor child pursuant to a Petition under Minn. Stat. 518 subject to parenting time by Petitioner as determined by the Court at a hearing on the 27th day of November 2013, at 8:00 a.m.
IT IS FURTHER ORDERED, that all responsive pleadings shall be served and filed not later than two (2) days prior to the scheduled hearing, exclusive of intervening Saturdays, Sundays and legal holidays, that the Court may in its discretion disregard any responsive pleadings served and filed less than two (2) days prior to such hearing and rule on Motion or matter in question.
