STATE OF MINNESOTA NOTICE OF HEARING FOR PROPOSED ASSESSMENTS FOR UNPAID ADMINISTRATIVE FINES AND SERVICE CHARGES RELATED TO CODE ENFORCEMENT
TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of the City of Otsego will meet at 7:00 PM on Monday, October 14, 2013 at Otsego Prairie Center, 8899 Nashua Avenue NE, Otsego MN 55330, to consider and possibly adopt the proposed assessment for unpaid administrative fines and service charges related to code enforcement plus administrative costs incurred in relation to the assessment in accordance with the City Code. Adoption by the City Council of the proposed assessment against property may occur at the hearing.
A list setting forth the properties proposed to be assessed is attached to this notice. The proposed assessment is for one (1) year at the interest rate of eight (8) percent.
The owner of any property so assessed may at any time prior to certification of the assessment to the Wright County Auditor pay the whole of the assessment on such property with interest accrued to the date of payment to the City of Otsego Treasurer except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of the assessment. The property owner may at anytime thereafter pay to the City of Otsego Treasurer the whole of the assessment with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year.
An owner may appeal their assessment to the District Court pursuant to Minnesota Statutes 429.081 by serving notice of appeal upon the Mayor or City Clerk within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within ten (10) days after service upon the Mayor or City Clerk. However, no appeal may be taken on the amount of the assessment unless a written objection signed by the property owner was filed before the hearing for the assessment or presented to the presiding officer at the hearing unless the failure to object was due to reasonable cause.
