The Elk River City Council has postponed until July 18 action that could lead to the shut down of Wapiti Park Campgrounds in Elk River.
City Attorney Peter Beck has prepared a seven-page draft resolution to revoke Wapiti Park’s conditional use permit. The council had the resolution before it on Monday, June 27, but Beck recommended that the council not act on it that night to give representatives of Wapiti Park time to review the resolution and comment on it. The city will accept additional written material on the matter through July 11.
Council members did not comment on the resolution and voted unanimously to continue the matter until July 18. Beck said if the council wants to revise the resolution or look at a different approach, it could continue the matter again on July 18.
“This is not a situation where there is a deadline for action,” he said.
The City Council had voted in April to begin the process of revoking Wapiti Park’s permit. One of the city’s chief concerns is its contention that people are living at the campground, located off west Highway 10 at 18746 Troy Lane.
If the council passes the resolution as written, Wapiti Park’s conditional use permit would be revoked effective Dec. 31 unless the campground meets six requirements.
Those requirements include:
•Submitting evidence to the city that it has renewed its license and is in full compliance with all requirements for renewal of the license as set for h by the Minnesota Department of Health.
•Removing vehicles which do not comply with the definition of “recreational camping vehicle” or “recreational vehicle” in state law.
•Removing all motor vehicles from the campground which are not operable and licensed as recreational vehicles or recreational camping vehicles.
•Removing all structures from within the campground other than the store building, the owner’s home, the barn and the bathhouse and restroom buildings.
•Having the onsite septic system tested by a Minnesota Pollution Control Agency-licensed septic system inspector and bringing it into full compliance with state and city regulations.
•Submitting a plan, which must be approved by the city council, for verifying that campers are not making vehicles, structures or tents within the campground their residence.
In a related matter, the council also voted 5-0 to not renew the campground’s liquor licenses.
